MIT encourages individuals to seek assistance for incidents involving sexual misconduct, intimate partner violence, or stalking. MIT provides a variety of options available to an individual, so that each person may choose a path for response best suited to his or her particular situation. MIT procedures are intended to protect the rights of the complaining party (“the complainant”), the accused (“the respondent”), and other participants in review of complaints.
Any allegation of gender discrimination including sexual misconduct, intimate partner violence, or stalking brought against an MIT student or employee, regardless of where the alleged incident occurred, will be taken seriously. Incidents alleged to have occurred off the MIT campus may be more difficult to investigate. If a person who is not a member of the MIT community notifies MIT of alleged sexual misconduct by an MIT student or employee, MIT will determine whether the conduct described is a sufficient risk to the safety of the MIT community to review further.
Except in those cases where the Complainant has contacted a strictly confidential resource, the Institute will conduct a prompt, thorough, and impartial investigation and will take appropriate measures to terminate the misconduct, prevent its recurrence, and address its effects. This response may include formal disciplinary action, which may be instituted by an individual complainant or the Institute itself. The sanctions of disciplinary suspension and disciplinary expulsion will be strongly considered when a student is found to have violated any part of the nonconsensual sexual contact, nonconsensual sexual penetration, sexual exploitation, or retaliation provisions of this policy, and for severe violations of the sexual harassment provision.
While an investigation or grievance proceeding is pending, MIT will take interim measures MIT concludes is appropriate under the circumstances to assist or protect persons who were or may have been subjected to sexual misconduct, intimate partner violence, or stalking, as well as to protect the MIT community from the misconduct reoccurring. Interim measures may include, for example, changing the living arrangements, class schedule, or work schedule of the Complainant or Respondent. During any stage of the investigation, if MIT reasonably suspects that a Respondent poses a threat of harm or disruption to the campus community, MIT may take immediate action, including removing a Respondent from housing (including FSILG), restricting the Respondent's movement on campus, and/or temporarily suspending the Respondent from MIT. Interim measures may also include offering the Complainant and Respondent counseling, health care, academic support, or other resources.
